Child Accident Claim

Child Accident Claim

Children at playChildren are naturally accident prone. Most times a child will have an accident due to their own clumsiness or natural inquisitiveness, suffering little more than a grazed knee and injured pride. Unfortunately, sometimes children are involved in more serious accidents that were not caused by their own fault. The most serious of these can cause a child a head injury. When your child is injured by someone else’s negligence, it may be possible to make a child accident claim.

What is the legal definition of a child?

A child in the eyes of the law is anyone under the age of 18. They are seen as ‘minors’ in legal terms. Children are treated differently legally in personal injury claim cases. They are for obvious reasons accepted to be less safety conscious than adults.

Time limits for children’s accident claims

Time limits imposed on personal injury claims for children are different from those imposed for adults. Instead of the three years from the date of the accident for adults, children have three years to bring a child accident claim starting from the date of their eighteenth birthday. However, the child’s parents can make a claim on their child’s behalf anytime up to their eighteenth birthday.

If the case is successful, the usual procedure is that a judge will decide a suitable compensation amount. The money will then be invested on behalf of the child and will be accessible when they turn 18 years old. The court does however release some of that compensation to the parents to cover such things such as medical or educational costs.
