Teenager Hit By Bus Wins Accident Claim Bonus

A teenage girl, crushed by a bus in June 2005 has had her accident claim payout increased. Chantelle Osei-Antwi of Forest Hill London had had her original compensation reduced in April 2009 after the Judge then ruled that she was partly culpable for the accident by not assessing the danger posed by the double-decker bus. Miss Osei-Antwi appealed this decision at the Civil Court of Appeal in London. On June 15 2005, Chantelle had been walking to her job as a check out girl in Crystal Palace when she was hit by the bus. She was standing in the pedestrian part of the pavement at the time of the collision.
Lady Justice Hallett, sitting with Lord Justice Ward and Lord Justice Hughes ruled in the appeal hearing that as Chantelle Osei-Antwi was standing “several inches back from the edge of the road”, she was in no way at fault for the accident. The responsibility for the incident they therefore placed firmly on the miscalculation of the bus driver.
Miss Osie-Antwi suffered serious injuries due to the accident, including damage to her left ankle which required surgery. Her original accident claim award of £12,000 has been raised to £18,000 with London and Kent Bus Company ordered to pay legal costs.
